假球案 陳致遠等人判刑確定

（中央社記者劉世怡台北13日電）台灣高等法院今天宣判中華職棒假球案，前職棒球員陳致遠判有期徒刑6月、蔡豐安6月、張誌家4月、楊博任6月確定，都可易科罰金。

職棒20週年總冠軍賽民國98年10月落幕，隨即爆發職棒打假球案，前職棒球員曹錦輝、張誌家與陳致遠等多名明星球員涉入；當時的板橋地方法院檢察署99年偵結後，陳致遠、蔡豐安、張誌家及楊博任等人被依詐欺等罪起訴，曹錦輝則獲不起訴。

新北地院100年6月間就中華職棒打假球案宣判，前台南縣議會議長吳健保、組頭蔡政宜、余則彬及張誌家、陳致遠等球員，共計23名被告被判1月15天到7年不等刑期，總併科罰金超過新台幣5000萬元。

全案經上訴，由高院審理。法官宣判時表示，原審未考量中華民國刑法新舊法適用，併科罰金部分全部拿掉；另因刑法新舊法適用，95年7月前犯罪，應視為連續犯，僅論一罪，被告刑度都降低。1030813
